Man Charged with Manslaughter after a child drowns in his pool.
A New South Wales (NSW) pool owner was recently charged with manslaughter ater a young child who was visiting a neighbouring property drowned in his backyard swimming pool. The police allege that the man negligently caused the death of the two-and-a-half year old boy by failing to provide and maintain a compliant pool barrier. The boundary fence, which also acted as a pool barrier, had been in a state of disrepair for up to 12 months and remained in that state on the afternoon the child gained access to the swimming pool.
It is believed to be the first time a charge of this kind has been laid where a person failed to ensure that pool barriers met pool safety standards.
NSW commenced a review of its pool safety laws in January 2012 with the release of the Swimming Pools Act 1992 Review Discussion Paper. The paper foreshadowed improvement options similar to those in place in Queensland, such as a state based pool register and the requirement that local governments implement an acceptable and afordable pool barrier inspection program.
The Pool Safety Council provided a submission on the discussion paper about the development and success of Queensland’s pool safety reforms. Since the introduction of the Queensland pool safety laws, three young children have lost their lives in swimming pools in a 19-month period. By comparison 12 young children drowned in the 17 months prior to 1 December 2010.
